Welcome to BayreBooks! These Terms and Conditions (“Terms”) outline the rules and regulations governing your use of our website (the “Service”) operated by BayreBooks (“us”, “we”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access or use the Service.
1. Use of the Service
The Service is intended for use by individuals who are at least 18 years old. By using the Service, you represent and warrant that you are of legal age to form a binding contract with BayreBooks.
You may not use the Service for any unlawful or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
2. Orders and Payment
- Placing an Order: You can place orders for books through our website. When you place an order, you are offering to purchase the selected items at the listed prices.
- Payment Methods: We accept various payment methods, including mobile money (MPESA LIPA NAMBA 56 91 296), credit/debit cards (Visa and Mastercard), and cash on delivery (COD for Dar es Salaam orders only). Full payment is required upfront for all orders shipping outside of Dar es Salaam.
- Order Confirmation: We will send you a confirmation email after placing your order. This email will include details about your order and payment instructions (if applicable).
- Order Cancellation: We reserve the right to cancel your order at any time for reasons including but not limited to: item unavailability, payment errors, or suspected fraud. We will notify you by email if your order is cancelled.
3. Delivery
- Delivery Options: We offer free and paid delivery options depending on your order value and location in Tanzania. You can find more details about our delivery zones, rates, and estimated timeframes on our Delivery page.
- Delivery Confirmation: All deliveries require confirmation by phone call. We will also send you a copy of the bus company receipt (for regional deliveries) to confirm shipment of your books.
- Delivery Delays: In rare cases of unforeseen delivery delays, the regional bus company assumes liability. We will do our best to assist you in such situations, which may include offering replacement books at a discount.
4. Returns and Exchanges
- Return Window: You may return unopened and undamaged books within 24 hours of receiving your order.
- Exchange Policy: We offer exchanges for unopened and undamaged books within 24 hours for another book of equal or lesser value.
- Refund Policy (Exceptions Only): We will only offer a refund in exceptional circumstances, such as receiving the wrong book or receiving a damaged book that we cannot replace. Refunds will be issued to your original payment method within 7 business days of receiving your returned book. Return shipping costs are not refundable.
- Items Not Eligible: We cannot accept returns or exchanges for opened or used books, books damaged due to customer negligence, or items returned after the 24-hour window. For detailed information on our return and exchange policy, please refer to our Returns & Refunds page.
5. Intellectual Property
The Service and all content included on the Service (including but not limited to text, graphics, logos, images, and software) are the property of BayreBooks or its licensors and are protected by copyright and other intellectual property laws.
6. User Content
You may be able to submit reviews, comments, or other content (“User Content”) to the Service. You retain all ownership rights in your User Content. However, by submitting User Content to the Service, you grant BayreBooks a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and translate your User Content in any media.
7. Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. BayreBooks disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
BayreBooks does not warrant that the Service will be uninterrupted, secure, or error-free. BayreBooks does not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
8. Limitation of Liability
In no event shall BayreBooks, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, even if BayreBooks has been advised of the possibility of such damages.
9. Termination
We may terminate your access to the Service for any reason, at any time, without notice. You may also, at any time, cease using the Service.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of Tanzania, without regard to its conflict of law provisions.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the arbitration rules of the Arbitration Association (“Rules”). The arbitration shall be held in Dar es Salaam, Tanzania, and you and BayreBooks consent to the exclusive jurisdiction and venue of such courts in all matters relating to the arbitration.
12. Entire Agreement
These Terms constitute the entire agreement between you and BayreBooks regarding your use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
13. Changes to the Terms
We reserve the right to update these Terms at any time by posting the revised Terms on the Service. Your continued use of the Service after the revised Terms are posted constitutes your agreement to be bound by the revised Terms.
